FourKites’ trademarks and service marks, logos, and brands (“Trademarks”) are FourKites’ intellectual property and are among our most valuable assets. In order to preserve and protect these Trademarks, it is essential that they are used properly. Follow these Guidelines and our Brand Guidelines for using FourKites’ Trademarks properly in all communications, documents, and electronic messages.
Third-party use of the FourKites Trademarks requires a license or written permission from FourKites. If you are interested in obtaining a license to use a FourKites Trademark, contact us to discuss your proposed use.
These Guidelines apply to FourKites employees as well as to customers, partners and other third parties that FourKites has licensed or otherwise granted written permission to use a FourKites Trademark (each a “Licensee”). If you are a Licensee of a FourKites Trademark, your license agreement may have particular usage guidelines different than provided here. If so, please follow the specific guidelines in your agreement. If you are a Licensee but have not been provided with special guidelines for usage of the FourKites Trademarks, then these Guidelines apply to your usage of the FourKites Trademarks.
You may reference FourKites’ products and services using the FourKites Trademarks, so long as such references are: (1) truthful, fair, and not misleading and (2) comply with these Guidelines, which may be modified from time to time by FourKites in its sole discretion. The FourKites Trademarks should never be used in a way that could cause anyone wrongly to believe that your products or services are offered, endorsed, or sponsored by FourKites or any of its subsidiaries.
Specific Requirements
Trademark Notices
a. Designate Status of Trademark:
- Properly designate the status of each FourKites Trademark by using the correct trademark symbol (® or ™ or SM) reflecting FourKites’ ownership, which is set forth here based on the country where the Trademark is used. If a Trademark has been registered, the ® registration notice should be used (e.g., FourKites®). If the trademark is not registered, the common law notices ™ for a trademark and SM for a service mark should be used.
- In letters, memos, press releases, white papers, advertising, slides, foils, video, and other multimedia presentations:
- Properly designate (with ® or ™ or SM) all of the FourKites Trademarks at the most prominent use (usually a headline) and again on the first occurrence in copy; and
- In the case of presentation graphics, Trademarks should be designated with the proper trademark symbol on each page, slide, and foil.
- In newsletters, magazines, and publications containing multiple articles:
- Properly designate (with ® or ™ or SM) all of the FourKites Trademarks on the first occurrence in the document, in headlines, and on the first occurrence in every article in which they are used.
- In brochures, annual/quarterly reports, books, technical documentation, and other bound documents:
- Properly designate (with ® or ™ or SM) all of the FourKites Trademarks on the first occurrence in the document, in headlines, and on the first occurrence in text.
- In all charts or graphs, properly designate Trademarks (with ® or ™ or SM).
b. Attribution to FourKites:
Include an attribution to FourKites as the owner of the Trademark in the following format: “[list the Trademarks used] is a trade- and/or service mark of FourKites, Inc.” If you are a Licensee of a FourKites Trademark, add “Used under license.”
Use Trademarks as a Proper Adjective, Do Not Use as a Verb or a Noun and Do Not Make Possessive or Plural
Use the FourKites Trademarks only as proper adjectives. Whenever possible the Trademark should be followed by the common descriptive name (noun) of the product or service it modifies (e.g., “the FourKites® Visibility Cloud Platform provides real-time visibility and data driven insights”).
FourKites Trademarks should not be used as verbs or nouns or in plural or possessive form.
Use Trademarks to Identify FourKites as a Single Source of Products and Services
Do not use Trademarks as a mere description of the nature of the product or service or as an identification of a product/service type or product/service category as a whole. Trademarks must be used to identify FourKites as the single source of a product or service.
References to FourKites, Inc.
When FourKites is used to refer to our company, FourKites, Inc., rather than as a brand of product or services, then the rules for proper usage change slightly. Unlike trademarks, company names are proper nouns; they can be used in the possessive form and do not need to be followed by a generic term. Neither the ™ or SM nor the ® symbol should accompany references to FourKites as a company.
Example
Correct: FourKites is now offering its customers more choices than ever.
Incorrect: FourKites® is now offering its customers more choices than ever.
FourKites Word Marks
When using our Trademarks that comprise only a word (i.e., no logo or stylized font), you may not change their appearance by abbreviating them, incorporating them into acronyms, changing their spelling, using them in parts, or using improper capitalization.
FourKites Logos
When using our Trademarks that include a logo or stylized font ("Logo"):
- Use the FourKites-approved Logo located in the Brand Guidelines and follow the style and usage guidelines available in our the Brand Guidelines.
- Logos will be updated from time-to-time. You will be required to periodically check the site and begin using the new Logo as soon as reasonably possible after release of the updated guidelines.
- Use the Logo exactly as provided by FourKites. Do not alter or distort the Logo in any way other than size, knowing the scale of the Logo must remain consistent. For example, do not add your own design elements or change the font or colors.
- Allow for clear space around our Logo, maintain the legibility of our Logo, and keep our Logo sharp, clear, and well-produced.
- Do not combine our Logo with any other object, including other logos, icons, images, works, graphics, photos, slogans, numbers, symbols.
- Do not remove trademark or registration symbols in the Logo.
